Maintaining IR35 Compliance

Many NHS organisations have a dependency on specialist and flexible information technology resources to complement their existing workforce and now have the responsibility for confirming the IR35 status of these resources. The HCI Group’s Services-based contracts provide a services/deliverables based solution that moves away from the traditional resourcing based approach that assist our NHS customers in maintaining IR35 compliance.

At HCI we are able to specify specific deliverables and combine these into fixed price services so our customers’ can be confident in HCI managing the process and collaborative working and shared management burden. Through a services based contract for deliverables our customers’ should be able to take advantage of a reduced workload in terms of agency cap reporting and with Trust and HMRC guidance help to mitigate the impact of IR35 changes in the Public Sector.

IR35 Compliance

As the consultants provided to our customers are fulfilling roles which are project based or temporary in nature and as HCI is able to substitute resources (reflected in our contracts) we provide resources which do not fall within the IR35 Intermediaries Act and therefore can supply Trusts with IR35 compliant services.

In addition to the supply of high quality IM&T implementation and delivery teams we are also able to provide solutions for NHS customers where direct agreements are in place between a Trust and self-employed contractors. This provides reassurance to the Trust and to the consultant that the engagement is compliant, and that HCI can provide a substitute quickly and effectively safeguarding programme delivery.

*Public Sector bodies need to ensure they are fully compliant with IR35 regulations and should seek professional advice about this subject as HCI are unable to provide HMRC guidance to customers.
